1. Acceptance
By creating an account at EsferaUp you accept these terms and the Privacy policy. If you do not accept them, do not use the service.
2. Accounts and registration
To register you must be 18 or older and provide accurate data. You are responsible for keeping your password confidential. Children under 14 only exist as profiles within an adult holder's account.
3. Permitted use
You may use EsferaUp for personal and family use. You may not: resell access, reverse engineer, attempt to access other families' accounts, or use the platform for commercial purposes without prior agreement.
4. User content
You keep ownership of the photos, notes, UPs and Memories you create. You grant us a limited license to store and process them for the purpose of providing the service. We do not use your content to train AI models.
5. Subscriptions and payments
Premium features (Activa plans, unlimited 360° observations) are billed monthly or annually. You can cancel anytime: cancellation takes effect at the end of the paid period. We do not provide partial refunds except where required by law.
6. 360° places and observations
Observations sent by schools, psychologists and other specialists are only visible to you and the place that created them. You can revoke a place's access at any time; observations already sent remain your property.
7. Hypothetical patterns and AI
The "Patterns" the system synthesizes from your UPs are statistical hypotheses, never clinical diagnoses. If you have health or development concerns, always consult a professional. EsferaUp does not replace pediatric, pedagogical or psychological care.
8. Limitation of liability
We offer the service "as is". We do not guarantee that it will always be available or error-free. Our maximum liability shall in no case exceed the amount paid by you in the last 12 months, except where the law imposes a higher limit (personal injury, intent).
9. Termination
You can close your account at any time from Settings → Account. We may suspend or close accounts that violate these terms, always with prior notice except in cases of imminent risk to other users.
10. Applicable law
These terms are governed by Spanish law. For any dispute, the competent courts are those of Barcelona, without prejudice to consumers' rights to seek their local courts.
